在中国，比特币交易并非违法行为。虽然目前国家尚未全面禁止比特币交易，但对于民间公民个人投资比特币的态度仍是不太积极的。比特币本身并非法定货币，而是作为一种虚拟商品而存在。因此，若消费者有意参与比特币交易，需自行承担由此产生的所有风险。依据我国现行相关法律法规，并未明示禁止比特币的流通交易，这并不代表比特币的交易全然合法。作为一种植根于虚拟世界的代币形式，比特币无法像人民币那样被广泛用于日常经济活动中。尽管如此，我国境内仍有少量比特币投资者的存在。
