这是网上众多被贩卖的“美女虐杀动物”视频中的一部，在这些视频中，小鸡、仓鼠、小猫、小狗、金鱼，甚至于大型的羊、牛、驴等动物，都是被虐杀对象。

据不完全统计，仅一名女孩近几年拍摄的162部视频中，就涉嫌虐杀4只小鸟、8只小猫、33只兔子、58只小狗，以及几十只仓鼠和小鸡。

“网红”虐杀动物：暴力邪典违法不必诉诸动物福利

“Red” killing animals: violent evils do not have to resort to animal welfare

据新京报报道，网络上订购、制作、贩卖“美女虐杀动物”视频，居然成为一个黑色的产业链。穿着丝袜、高跟鞋的女孩，口中念念有词，将一只小兔子置于高跟鞋下活活踩死……类似这种虐杀动物视频，被人在网上以每部数十元至数万元的价格贩卖，内容血腥残忍，甚至还可以付钱“定制”。一个叫阿佳(化名)的女性：用高跟鞋踩踏虐杀乌龟，开价500元;用阉割、剥皮等方法虐杀驴，她开价15000元。

这样的“网红”虐杀动物的黑产业，真是让人三观尽毁。但这个产业又似乎处于管理空白地带，有学者、律师认为，虐待家禽、宠物等动物涉及的是动物福利法，但相关立法在我国尚属空白，可能导致无法可依的尴尬。

But the industry seems to be in a regulatory vacuum, with scholars and lawyers arguing that the abuse of animals such as poultry and pets is related to animal welfare laws, but the relevant legislation is still lacking in our country and could lead to indefensible embarrassment.

其实，早在2010年“虐兔门”视频就在网上热传一时，这个产业在中国也算有较长的时间了。应该将之明确定性为网络色情的一种，而不必等待中国动物福利的立法。

Young women kill small animals with explicit sexual connotations and then turn them into bloody videos, the subculture of which is called crush fetish, which is a form of sexual pervert. The beauty of a beautiful girl who masturbates animals, both beautiful and bloody, “yellow and violent” to satisfy the deformed desires of some people, which are also part of the “monsteric” film.

所以，必须认识到“网红”虐杀动物这个黑产业的严重社会危害。《中华人民共和国网络安全法》明确规定，严禁“传播暴力、淫秽色情信息”，对于传播暴力色情视频产品，其法律责任并不比传播淫秽物品的低，但是，相关执法标准应该跟上。

Therefore, it is important to recognize the serious social danger of the “net-red” killing of animals as a black industry. The Law of the People's Republic of China on Cyber Security clearly stipulates that “the dissemination of violent, obscene and pornographic information” is strictly prohibited and that legal responsibility for the dissemination of violent pornographic video products is no lower than for the dissemination of pornographic material, but the relevant law enforcement standards should be kept up to date.

而且，解决这个黑色产业链，不必消极等待中国动物福利的立法。找一些女孩穿着丝袜、高跟鞋等明显有性挑逗的服装去踩踏、虐杀小动物，严重挑战社会的公序良俗，其侵犯的法益其实并不主要是“动物权利”，而是严重败坏了社会道德。

Moreover, resolving this black industrial chain does not have to wait passively for legislation on the welfare of Chinese animals. Looking for girls in apparently sexually provocative clothing like stockings, heels, etc. to step on, kill small animals, and seriously challenge the public order and good customs of society, the law of aggression is not essentially “animal rights” but rather a serious violation of social morality.

这种“血腥恋物癖”本质也是色情产业的一部分。它对社会造成的危害，主要不在于动物被虐待——毕竟中国作为发展中国家，对于动物福利的社会共识还有很长的路要走——而是公然宣扬暴力、情色，将之明码标价，是钱色交易的一种，并且可能诱发变态的暴力犯罪，其社会危害甚至远大于普通淫秽制品。

This “bloody fetish” is also part of the sex industry. The harm it causes to society is not primarily the abuse of animals — after all, China, as a developing country, has a long way to go in terms of its social consensus on animal welfare — but rather the blatant promotion of violence, passion, explicit pricing, a kind of money-trading, and the potential to induce deviant violent crime, with social harm much greater than ordinary pornography.

所以，从法律渊源角度说，治理“网红”虐杀动物问题，不必等到中国的相关动物福利，而是应该充分利用《网络安全法》严禁“传播暴力、淫秽色情信息”的规定，将“网红”虐杀动物作为色情、暴力的互联网内容，予以依法打击。辣眼睛的网络黑产业，必须拿出更果断的执法手段，暴力邪典已然违法，不必诉诸动物福利。

So, from a legal point of view, it is not necessary to wait for the relevant animal welfare in China to address the problem of “net red” killing, but to make full use of the provisions of the Cyber Security Act prohibiting “the dissemination of violent, obscene and pornographic information” and using “net red” killing of animals as an Internet component of pornography and violence to be combated in accordance with the law. The hot-eyed Internet black industry must be more decisive in enforcing the law, and violent cults are illegal and do not need to resort to animal welfare.
