中新网重庆6月23日电 (记者 刘贤)微信预售国外直邮大麻、境外购买大麻油……23日，重庆市第一中级人民法院发布的毒品犯罪典型案例显示，毒品犯罪呈现作案手段隐蔽化、毒品种类复杂化、支付方式新型化等特征。

陈某是个酒吧主持人。2019年7月25日，他通过网络以0.20424比特币，约折合人民币1.4万余元的价格，购买国外直邮的大麻叶，用于自己和酒吧的说唱歌手吸食，并在微信上预售。
Chen was a bar host. On 25 July 2019, he purchased, via the Internet, at a price of 0.20424 bits equivalent to more than RMB 14,000, cannabis leaf in direct mail from abroad, for use in his own and the bar's rappers, and pre-sold it on a micro-mail.
同年8月4日，陈某前往投揽站收取邮件时被公安民警当场抓获。经称量并提取检材送检鉴定：该邮件内查获的毒品大麻叶共净重204.97克，含有四氢大麻酚成分。

法院认为，大麻叶属于我国刑法打击的毒品范围。被告人陈某违反海关和毒品管理的相关法规，从美国购买大麻叶，不仅用于自己和他人吸食，还有贩卖的故意和行为，构成走私、贩卖毒品罪。据此，法院判处陈某有期徒刑六个月，并处罚金人民币10000元。
The court found that the cannabis leaf fell within the scope of our criminal law to combat drugs. In violation of the relevant customs and drug regulations, the defendant Chen was sentenced to six months' imprisonment and a fine of RMB 10,000 for purchasing it from the United States, not only for consumption by himself and others, but also for intentional and deliberate trafficking in it.
境外购买大麻油走私毒品获拘役

无独有偶，无业人员苏某2019年1月向美国卖家购买两支毒品大麻油，双方约定由卖家在美国安排以国际快递的方式将两支毒品大麻油邮寄入境。

同年1月23日，苏某在重庆将该国际快递包裹签收。同年2月，苏某再次以相同的方式向美国卖家购买三只毒品大麻油邮寄入境。2月15日，苏某将该国际快递包裹签收后被民警当场抓获，查获三支总净重为2.05克的毒品大麻油。

苏某到案后主动交代了第一次从境外购买毒品大麻油的事实，并将家中未吸食完的第一次购买的两支总净重为1.08克的毒品大麻油上交重庆海关缉私局。经鉴定，上述查获的五支疑似大麻油中均检出四氢大麻酚、大麻二酚、大麻醉成分。

法院认为，根据《最高人民法院、最高人民检察院、公安部关于规范毒品名称表述若干问题的意见》的规定，对于含四氢大麻酚、大麻二酚、大麻酚等天然大麻素类成分的毒品，根据其外形特征可分为大麻叶、大麻脂、大麻油或者大麻烟。大麻油属于我国《刑法》打击的毒品范围。被告人苏某从境外购买大麻油3.13克供自己吸食，其行为符合走私毒品罪的犯罪构成要件，依法应予惩处。苏某走私毒品数量很少且属于初犯，归案后如实供述犯罪事实，主动交代了公安机关未掌握的其第一次走私大麻油的事实，并主动上交毒品，社会危害性较小，有认罪悔罪表现，可从轻处罚。据此，法院依法对被告人苏某判处拘役二个月，缓刑三个月，并处罚金3000元。

Su, who is the first offender in very small quantities and is guilty of the crime, voluntarily submits to the public security authorities the facts of his first smuggling of cannabis oil that are not known to him, and is willing to hand over the drug, is less dangerous, has a confession of guilt and can be lightly punished. On this basis, the court sentenced Su, in accordance with the law, Su, to a prison term of two months, three months's probation and a fine of 3,000 yuan.
